🛡️ Updated Terms of Service for HeartWhisperer AI

1. General Provisions
These Terms of Service define the principles for using the HeartWhisperer AI web application, hereinafter referred to as the “Service.”
The Service is operated by MarcinLocum Ltd., United Kingdom.

Use of the Service constitutes acceptance of these Terms and the Privacy Policy.
2. Nature of Services
- The Service offers AI-powered features, including: individual conversations, dialog rooms, self-reflection module, message creator, content and emotion analysis, personal AI rooms, AI story summariser, and a virtual Emotional Assistant.
- The Service supports communication, self-awareness, and personal development.
- HeartWhisperer AI DOES NOT constitute or replace professional medical, psychological, or legal care, diagnosis, therapy, crisis intervention, or specialist consultations. Content generated by AI is for informational and reflective purposes only. All decisions are made at the user’s own responsibility.
3. User Account
- Using the Service requires creating an account (Google/email).
- The user is responsible for the security of their account and login credentials.
- Guest accounts have limited functionality (e.g., no chat history or premium features).
- Sharing the account with third parties is prohibited.
4. Payments
- Access to certain features requires the purchase of tokens.
- Payments are processed by Stripe. The Service does not store payment card details.
- Tokens are activated immediately after purchase and are non-refundable unless otherwise provided by law.
- The Operator may introduce promotions and test tokens.
5. User Responsibility
- Use the Service in accordance with the law and principles of social conduct.
- It is prohibited to publish content that is unlawful, infringes on rights of others, offensive, contains personal data of third parties without consent, or may cause harm to others.
- The user is fully responsible for their own published content.
- The Service is not intended for individuals in severe emotional crisis, with suicidal thoughts, or experiencing violence/threats to life. In such cases, immediately contact emergency services or a specialist.
- By using features for couples, the user declares they have obtained the other person’s consent to participate in the conversation.
6. Disclaimer – AI Limitations and No Professional Advice
- The Service uses AI models to generate content and analyses. AI may be incorrect and may generate misleading, incomplete, or inadequate information.
- Responses generated by AI are not diagnoses, treatment, therapy, psychological, legal, medical advice, clinical recommendations, or specialist consultations.
- The Service does not assess the user’s health, conduct clinical evaluations, or provide therapeutic interventions.
- AI may create imprecise content, logical errors, is unaware of the full context of the user’s life, and lacks consciousness or specialist expertise.
- The Operator is not responsible for actions taken or omitted by the user as a result of interpreting content generated by AI.
- The Service provides tools for self-reflection, communication, and exploring emotions.
7. Technical Requirements and Limitations
- A stable Internet connection and up-to-date browser are required.
- The Operator is not liable for interruptions caused by breakdowns, force majeure, or third-party services.
- AI may generate information inconsistent with facts and users should verify it independently.
- The Operator may introduce limits on the number of rooms, messages, AI requests, or active sessions.
8. Intellectual Property
- The name, logo, graphics, interface, source code, and layout of the Service belong to the Operator.
- The user retains rights to their own content but grants the Operator a non-exclusive license to use it as necessary for operation, quality improvement, and ensuring safety.
9. Privacy Policy
The principles of data processing are specified in the Privacy Policy. Using the Service means acceptance of the Privacy Policy.
10. Complaints

- The Operator reviews complaints within 14 days.
11. Supplemental Terms of Liability
- The Service may contain technical or substantive errors. The Operator does not guarantee full accuracy or availability of services.
- The Service does not guarantee that AI actions will meet user expectations.
- The Service is not responsible for loss of data due to external factors, errors of third-party services (Firebase, OpenAI, Stripe), improper use of the Service, or consequences of decisions based on AI-generated content.
- The Service is not liable for any content sent between users or third parties.
12. Final Provisions
- The Operator may change these Terms of Service. Information about changes will be published in the Service.
- Using the Service after changes means acceptance of the new Terms.
- Any matters not covered herein are governed by the law of the United Kingdom.
